Subject matter of the contract
Is the implementation of a project for workplace health promotion. Project contents are the implementation of movement courses with the aim of promoting mobility, coordination, strength and endurance in the form of courses in business and sports clothing. In addition, lectures and workshops to raise awareness and provide information about exercise, nutrition, sleep and back health. In addition, the sending of content in the form of videos and articles on relevant health topics can be part of the subject matter of the contract. In the specific offer for the customer, these items are listed exactly according to type, location and frequency.

Training location and time
The group lessons organized by FitnessGoesOffice take place at the times and places agreed upon in the contract. In case of necessary changes at short notice (weather, traffic, infirmity, accidents etc.) the participants will be informed personally or by phone.

Costs and payment
The contractually agreed prices apply; costs for training facilities and activities that deviate from the contract must be paid separately by the customer. Terms of payment:

Order volume up to 5.000.-: 4 weeks after project start
Order volume over 5.000.-: 50% each 4 weeks after project start and 50% in the middle of the project

Cancellation conditions
Appointment cancellation by the customer
If the agreed group appointment cannot be kept by the customer, FitnessGoesOffice will try to find an alternative date. If this is not possible for scheduling reasons, this unit will be cancelled without replacement. The cancellation of the appointment must be made at least 24 hours before the due date, otherwise the cancelled hour will be charged.

Cancellation due to bad weather
In rare cases, group training may be cancelled due to bad weather and/or unavailable facilities (hall, etc.). In this case a new date will be arranged. If this is not possible, the amount already paid for this unit will be refunded. The customer himself is responsible for the selection of suitable clothing.

Liability
FitnessGoesOffice works exclusively with healthy people. All questions concerning the state of health have to be answered truthfully and completely in the personal assessment (questionnaire, interview) to the trainer. The information will be kept confidential by FitnessGoesOffice. Acute or chronic illnesses that can affect the performance have to be reported to the supervising trainer immediately. FitnessGoesOffice is not liable for accidents, injuries or damages that the training participant suffers due to misjudgment of his or her physical capacity or due to any other circumstances (e.g. if the participant does not follow the instructions of the trainer). Any liability for personal injury or damage to property that is not due to a grossly negligent or intentional breach of duty by the trainer is excluded by law. The participant has been informed about the dangers and circumstances associated with the training and expressly confirms with his signature that he is participating in the training at his own risk and responsibility. The participant agrees that photos and videos taken during the training may be published on the website, Facebook, LinkedIn and Instagram of FitnessGoesOffice.

Material
Material (mats, Thera-bands, balls, etc.) that is provided by FitnessGoesOffice to carry out the exercise units must be returned to FitnessGoesOffice after the end of the project. In case of loss of material or damage beyond natural wear and tear, the customer is obliged to compensate the damage.

Passing on of contents
All rights to content (photos, articles and videos) are the exclusive property of FitnessGoesOffice. Any kind of duplication and transfer (sale, rental, lease, etc.) of concepts and contents of the customer to third parties is prohibited during the contract as well as after the end of the contract without the written, prior and explicit permission of FitnessGoesOffice. Likewise, any modification of the content is prohibited, in particular reworking, further development and translation. The customer is liable to prosecution in case of violation of the above provisions.

Data protection
All personal customer data is stored and processed exclusively for the purpose of individual, personal support, the sending of information to support the training or corresponding offers. All information will be treated in strict confidence, protected with appropriate IT tools and will not be passed on to third parties, especially not to the employer and his environment.

Miscellaneous
The place of jurisdiction for all disputes arising from this agreement and in connection with the general terms and conditions is Korneuburg / Lower Austria. The contractual relationship is subject to Austrian law. If individual parts of the contract should prove to be ineffective or unfeasible or if it turns out that the contract does not regulate issues that should have been regulated, the partners agree to find amicable solutions for these open points.

Supplementary General Terms and Conditions for Online Live Training

Conclusion of contract

After receipt of your order you will receive an automatic e-mail confirming that we have received your order. With the payment option bank transfer you will receive an invoice in this e-mail. Only after receipt of the invoice amount the purchase contract is concluded and access to the online live training is activated.
With the payment options credit card, direct bank transfer and Paypal the contract is concluded immediately with your order.

Price

The price for the online live training includes the legal value added tax. Minimum order duration is 30 days for 19,90€. The subscription period can be extended and the price cumulated accordingly. 

Term of notice

The Online Live Training subscription is automatically renewed after 30 days. Up to 5 days before the end of the subscription period you can informally send an e-mail to fgonline@fitnessgoesoffice.com the subscription can be cancelled. The start date of the subscription can be found under "my account".

Liability Online Live Training

The online live training is only aimed at healthy people. Not all exercises shown in the online live training units or the videos are suitable for everyone. Avoid excessive eating before the training. To reduce the risk of injury, avoid overstraining and jerky movements. Possible restrictions due to chronic or acute illnesses or for women in pregnancy must be strictly observed. FitnessGoesOffice is not liable for any injuries, diseases or damages as a result of the training participation.

The online live training does in no way replace or represent medical therapy or medical treatment. FitnessGoesOffice recommends to consult a physician in case of health problems.
